Research Handbook on General Principles of Eu Law

Instead of arguing for a uniform and coherent definition of what a general principle of law should look like in the EU legal order, this research manual identifies the conceptual, theoretical and legal parameters within which the doctrine of general principles of EU law can be meaningfully discussed and challenged. The different analytical levels integrated in this research manual make it possible to know whether the general principles are defined by the different contexts in which they apply; whether the general principles lead to greater coherence between the different areas of Union law in practice; and the challenges they pose to the EU legal order. The chapters thus contribute to a refined methodological and doctrinal understanding of the general principles of the EU legal order. This research manual provides a comprehensive study of existing and emerging general principles of EU law by researchers from a wide range of expertise in EU law, international law, legal theory and various areas of substantive law. It examines the theory, content, role and function of general principles in Union law in order to better understand general principles as a mechanism for transparency of the content of the Union legal order and for mutual enrichment and coherence of legal systems. Its potential as a tool for managing the interaction of legal systems is the subject of particular attention and makes this manual an important addition to the literature on the subject. The research handbook on general principles of EU law opens up new spaces for critical reflection on the concept, role, meaning and limits of general principles and will be an essential resource for researchers and students in European law, politics and integration and internationalisation theory. The handbook examines legal and scientific approaches and theories on the general principles of the EU legal order in the context of considerable uncertainty regarding the term. It does this by analysing a variety of general principles in individual areas of EU law (“zooming in”) and from external and broader perspectives on the concept of general principle of law in international law, comparative law and legal theory (“zooming out”). The research handbook on general principles of EU law opens up new spaces for critical reflection on the concept, role, meaning and limits of general principles and will be an essential resource for researchers and students in European law, politics and integration and internationalisation theory. My co-editors and I received funding from the Jean Monnet Project, in addition to a small research grant from the British Academy/Leverhulme, to study the role and importance of general principles of EU law, and in particular EU law. The attractiveness of general principles lies in their ability to provide a systematic framework for the development of a legal system. But there are many open questions about their regime-building characteristics, their claim to supremacy and consistency, and their origin and authority in constitutional legal systems. The project and book aim to navigate the many contexts where general principles are relevant to and in EU law, and to provide a critical account of their legal nature and the various functions they play in a range of legal and policy areas, including the relationship between EU law and international law. This innovative research manual examines judicial, scientific and theoretical approaches to the general principles of the EU legal order in the context of considerable uncertainties about this concept. To this end, it analyses both a large number of general principles in individual areas of EU law (`zoom in`) and external and broader perspectives on the concept of general principle of law from international law, comparative law and legal theory (`zoom out`).
